bestpeople Expert Terms of Use

PLEASE READ THESE TERMS CAREFULLY.


By sharing your LinkedIn connection data with us or providing any referral through the bestpeople platform, you agree to these Terms of Use. These Terms form a legally binding agreement between you and BESTPEOPLE AI LTD, a company registered in England and Wales with company number 16490804 and registered office at 111 Buckingham Palace Road, London, England, SW1W 0SR. The terms “Company”, “we”, “us” and “our” refer to BESTPEOPLE AI LTD. The terms “Expert”, “you” and “your” refer to the individual or organisation using the System and Services.


If you do not agree to these Terms, you must not apply to become an Expert, must not share your LinkedIn connection data with us and must not use the System or Services.



1. Who We Are and What These Terms Cover


We operate bestpeople, a referral-based recruitment platform designed to help Experts earn referral fees by identifying and recommending people in their professional network who may be suitable for roles listed on the platform.


These Terms apply to your use of:

  • the bestpeople website, tools and any related software (the “System”).

  • any related documentation (the “Documentation”).

  • the expert referral and reward services we provide through the System (the “Services”).


These Terms apply from the first date on which you:

  • submit an Expert application.

  • accept these Terms on our website.

  • share your LinkedIn connection data with us.

  • submit a referral.

2. Becoming an Expert


Experts join bestpeople by submitting an application through our website. You may be required to accept these Terms as part of that process. After submitting your application, our team may conduct an onboarding call before approving you to use the System.


As part of the onboarding process, you must request your LinkedIn data export and provide us with the file named connections.csv. This file contains only your connection data. Sharing this file is the final step for approval.


We may approve or reject applications at our sole discretion.


There is no separate written agreement. These Terms form the entire agreement between you and us regarding the Services.



3. Your Relationship with Us


3.1 Independent contractor

You act as an independent contractor. These Terms do not create any employment relationship, partnership, joint venture or agency between you and us.


3.2 No exclusivity

You are not required to refer exclusively through bestpeople. You may refer elsewhere at any time.


3.3 No guaranteed income

Referral fees are entirely dependent on Successful Candidate outcomes. We do not guarantee any income or minimum number of referral opportunities.


3.4 Removing Experts

We may remove or deactivate an Expert account at any time without notice. This will not affect your right to receive referral fees for any qualifying referrals already made.



4. Sharing LinkedIn Connection Data


4.1 How you share data

Experts share connection data by downloading the connections.csv file from LinkedIn and providing it to us. This is permitted under LinkedIn’s Terms of Service and is your personal data, which you are entitled to share. You confirm that you will only provide your own LinkedIn data export and will not use any scraping tools or unauthorised automated tools.


4.2 How we use your connection data

We only use your connection data to:

  • generate personalised referral suggestions for you.

  • match people in your network to open roles.

  • allow you to approve individuals for outreach.

  • operate, maintain and improve the System and Services.

  • track referrals and payments.

We do not contact anyone in your network without your explicit approval.


4.3 Your approval to contact a candidate

Approval may be given by replying to one of our emails, naming the individual, confirming their details, or by clicking to approve a suggested referral. Once approved, we may contact that candidate about the relevant role.


4.4 Licence to use data

You grant us a limited, revocable, non-transferable licence to store and process your connection data solely for the purposes described in these Terms and in our Privacy Policy.

We do not sell your connection data or use it for unrelated marketing.



5. Referrals and Successful Candidates


5.1 What counts as a Referral

A Referral is made when you:

  • identify a specific individual as a potential candidate.

  • approve a suggested connection we surface to you.

  • reply to our email confirming that we may contact the person.


5.2 Successful Candidate definition

A Successful Candidate is a candidate you referred or approved, who:

  • is hired by a client through bestpeople.

  • remains employed for more than 30 days from their start date.

If the candidate leaves or their employment ends within the first 30 days, the referral is not successful, and no referral fee is payable.


5.3 Candidate hired for a different role

If a referred person is hired for a different role than the one originally suggested, you will still receive the referral fee associated with the role they accept.


5.4 Multiple Experts referring the same person

The referral fee is awarded to the first Expert who makes a valid referral or approval. If the candidate was already known to bestpeople or already in our system before your referral, you will not be eligible for a referral fee.



6. Referral Fees and Payments


6.1 Fee amounts

Referral fees typically range between USD 5,000 and USD 10,000, depending on the role. The exact fee for each role will be shown on the System or communicated to you before you make the referral.


6.2 When referral fees are paid

Referral fees are paid:

  • only after the candidate has remained employed for more than 30 days.

  • only once the client has paid us for the placement.

  • only after you have completed payment verification.

If the client does not pay us, we are not required to pay the referral fee.


6.3 Payment method

Payments are made through Stripe or another secure third-party payment provider. Once a hire is confirmed and the employment contract is signed, we will request your payment details.


6.4 Individual or company payments

You may choose to be paid:

  • as an individual, or

  • through a company or other legal entity you control.


6.5 Tax responsibility

Experts are solely responsible for reporting and paying any taxes arising from referral fees. We do not withhold or remit taxes on your behalf.



7. Expert Visibility


Your name may be shared with clients as the referring Expert. This provides social proof and generally improves responses and outcomes.


You may opt out at any time by contacting support@findbestpeople.ai. If you opt out, we will anonymise your identity to clients.



8. Your Use of the System


In return for complying with these Terms, you may:

  • access and use the System to view and submit referrals.

  • receive personalised referral recommendations.

  • access Documentation we provide.

  • receive updates, notifications and candidate progress information.


You must not:

  • use the System in any unlawful or fraudulent manner.

  • attempt to reverse engineer or disrupt the System.

  • upload data you are not entitled to share.

  • infringe the rights of clients, candidates or other Experts.



9. Data Protection and Privacy


Your personal data is processed in accordance with our Privacy Policy at: https://findbestpeople.ai/privacy

This includes:

  • your connection data.

  • your contact details.

  • referral activity and history.

  • candidate progress notifications.


You may request deletion of your data at any time by emailing support@findbestpeople.ai. If you request deletion, we will retain only the minimal referral and payment history necessary for compliance and accounting.



10. Intellectual Property


All intellectual property in the System, Documentation and Services belongs to us or our licensors. You do not acquire any ownership rights.


If you provide feedback or suggestions, you agree that we may use them without any obligation to you.



11. Limitations of Liability


The System and Services are provided on an “as is” and “as available” basis. We do not guarantee:

  • that any candidate will be hired.

  • that you will earn referral fees.

  • uninterrupted or error free operation of the System.


We are responsible for foreseeable loss or damage caused by our failure to use reasonable care and skill. We are not liable for any business losses, including lost income, profits or opportunities.


Nothing in these Terms excludes liability for death or personal injury caused by negligence or for fraud.


Our total liability to you for any claim is limited to the amount of referral fees paid to you in the previous twelve months.



12. Termination


We may terminate or suspend your access to the System at any time. If we do, you will still be entitled to referral fees for any qualifying referrals made before termination.


You may request termination of your account at any time by emailing support@findbestpeople.ai.


On termination, you must stop using the System and we may revoke your access immediately.



13. Changes to These Terms


We may update these Terms to reflect legal, security or functional changes. We will notify you by email or through the System.


Your continued use of the System after any update constitutes acceptance of the revised Terms.



14. Governing Law and Jurisdiction


These Terms are governed by English law. You agree that the courts of England and Wales will have exclusive jurisdiction over any dispute.
